1. ABOUT THESE TERMS
These Terms of Service apply when you visit avilesprints.com, use this website or purchase a product from Aviles Prints.
Please read these terms together with our:

By placing an order, you confirm that you have read and accepted these terms.
Nothing in these terms limits or excludes any rights available to you under applicable consumer law.
2. ABOUT AVILES PRINTS
Aviles Prints is operated by Luis Avilés Ortiz, sole trader, trading as Aviles Prints in Ireland.

Our full business address, VAT information and business registration details are provided in the Contact Information policy linked from the website and checkout.
The online store is hosted using Shopify. Shopify provides the ecommerce platform but is not the seller of the products purchased from Aviles Prints.
3. ELIGIBILITY TO PLACE AN ORDER
To place an order, you must be at least 18 years old or otherwise legally capable of entering into a binding contract.
You are responsible for ensuring that the information supplied during checkout is complete and accurate.
4. PRODUCTS AND ARTWORK
We aim to describe and display every artwork, print, frame, size and product option as accurately as reasonably possible.
Colours may appear slightly different depending on screen settings, lighting and the characteristics of the printing process. Minor variations in colour, texture or positioning that are inherent to fine-art printing do not necessarily constitute a defect.
Product dimensions are stated as accurately as possible. Small manufacturing tolerances may occur.
Unless expressly described as an original artwork, products sold through the standard online catalogue are fine-art reproductions of artwork by Luis Avilés.
Frames, where selected, are supplied according to the option displayed on the relevant product page.
5. MADE-TO-ORDER PRODUCTION
Most products are produced after an order is placed.
Our standard catalogue prints, standard sizes and standard frame options remain subject to the cancellation and return rights described in our Return and Refund Policy, even though they are made to order.
Genuinely personalised, commissioned or bespoke products created to a customer’s individual specifications may be subject to different cancellation rights. Any special conditions applying to bespoke work will be explained before the order is confirmed.
6. PRICES, TAXES AND DELIVERY CHARGES
Product prices are displayed in the currency selected for the customer’s market where supported.
Applicable taxes, delivery charges and other costs will be displayed during checkout before the order is submitted.
Prices may change from time to time, but a price change will not affect an order that has already been accepted.
If an obvious pricing, product or technical error is discovered, we will contact you as soon as possible. We will not charge a higher price without your agreement. Where necessary, we may cancel the affected order and issue a full refund.
7. PAYMENT
Payment must be completed using one of the payment methods offered at checkout.
Payment processing may be handled by Shopify Payments or another authorised payment provider. Aviles Prints does not directly receive or store complete payment-card details.
An order may be declined or cancelled if:
• payment cannot be authorised
• the information supplied appears incomplete or incorrect
• fraud or unauthorised activity is reasonably suspected
• the product cannot be supplied
• an obvious pricing or technical error has occurred
If we cancel an order after payment has been taken, the amount paid will be refunded using the original payment method.
8. ORDER ACCEPTANCE
Submitting an order is an offer to purchase the selected products.
A contract between you and Aviles Prints is formed when we send an order confirmation accepting the order.
An automated acknowledgement does not require us to fulfil an order where payment has failed, fraud is suspected, a product is unavailable or an obvious error has occurred.
Please review your order confirmation carefully and contact hello@avilesprints.com promptly if any information is incorrect.
9. PRODUCTION AND FULFILMENT
Aviles Prints may use professional third-party production and fulfilment partners, including CreativeHub by theprintspace, to print, frame, package and dispatch orders.
The use of a fulfilment partner does not change the identity of Aviles Prints as the seller and does not reduce your statutory consumer rights.

10. SHIPPING AND DELIVERY
Available destinations, delivery charges and estimated delivery periods are shown at checkout where possible.
Delivery dates are estimates unless expressly confirmed as guaranteed.
Orders may be dispatched in separate parcels where products are made or stored at different locations.
Customers must provide a complete and accurate delivery address. Please contact us immediately if an address needs to be corrected. We cannot guarantee that changes can be made after production or dispatch has begun.

11. CANCELLATIONS, RETURNS AND REFUNDS
Your cancellation, return and refund rights are set out in our Return and Refund Policy.
For eligible online purchases, customers may notify us of a change-of-mind cancellation within 14 days of receiving the goods, subject to the conditions explained in that policy.
Nothing in these terms affects your rights where goods are damaged, faulty, defective or not as described.
12. COMMISSIONS AND BESPOKE WORK
Commissioned or bespoke work may be governed by an additional written quotation, brief, production schedule or agreement.
That document may specify:
• the agreed creative brief
• revisions included
• price and payment schedule
• expected completion time
• delivery arrangements
• permitted use of the commissioned work
• cancellation conditions
Where an individually agreed commission document conflicts with these general terms, the individually agreed document will apply to that commission, except where doing so would unlawfully restrict consumer rights.
Work will not normally begin until any agreed deposit or initial payment has been received.
13. INTELLECTUAL PROPERTY
All artwork, illustrations, photographs, product images, written content, branding, logos and website materials displayed by Aviles Prints are owned by or licensed to Aviles Prints unless stated otherwise.
Purchasing a print or original artwork transfers ownership of the physical item only. It does not transfer copyright or grant permission to reproduce, scan, copy, distribute, alter, license, manufacture from or commercially exploit the artwork.
Artwork may not be used for merchandise, advertising, publication, digital products, artificial-intelligence training datasets or other commercial purposes without prior written permission.
Customers may photograph purchased artwork for ordinary personal, non-commercial purposes, including sharing it in their home on social media, provided that the use does not falsely imply endorsement or transfer of authorship.
14. ACCEPTABLE USE OF THE WEBSITE
You must not:
• use the website for unlawful or fraudulent purposes
• attempt to interfere with its security or operation
• introduce malware or harmful code
• scrape, copy or extract website content without permission
• impersonate another person
• submit false payment, identity or delivery information
• use the website in a way that infringes the rights of Aviles Prints or another person
We may restrict access or cancel an order where there is reasonable evidence of fraud, abuse or unlawful activity.
15. THIRD-PARTY SERVICES AND LINKS
The website may use or link to services operated by third parties, including payment providers, delivery carriers and social-media platforms.
Those services may have their own terms and privacy policies. Aviles Prints is not responsible for the content or independent operation of an unrelated third-party website.
This does not remove our responsibility for fulfilment partners or service providers used by us to perform our obligations under your order.
16. WEBSITE AVAILABILITY
We aim to keep the website available and accurate, but uninterrupted access cannot be guaranteed.
We may temporarily suspend or modify the website for maintenance, security, technical or operational reasons.
Products, prices and website features may be changed or withdrawn. Changes will not affect an order already accepted unless required by law or agreed with the customer.
17. OUR RESPONSIBILITY
We are responsible for losses that are a reasonably foreseeable consequence of our breach of these terms or failure to use reasonable care and skill.
We do not seek to exclude or limit liability where doing so would be unlawful, including liability for:
• death or personal injury caused by negligence
• fraud or fraudulent misrepresentation
• defective products where liability cannot legally be excluded
• breach of statutory consumer rights
Aviles Prints is not responsible for losses caused solely by events outside our reasonable control where we have taken reasonable steps to minimise the effect of those events.
Nothing in this section limits your statutory rights.
18. EVENTS OUTSIDE OUR REASONABLE CONTROL
Production or delivery may occasionally be affected by events outside our reasonable control, including carrier disruption, severe weather, customs delays, industrial action, public emergencies, infrastructure failures or interruption at a production facility.
Where this happens, we will take reasonable steps to minimise the delay and keep affected customers informed where appropriate.
If a delay becomes substantial, any cancellation or refund rights available under applicable law will continue to apply.
19. PERSONAL INFORMATION
Personal information is handled in accordance with our Privacy Policy.
Information may be shared with service providers only where reasonably required to process payment, produce an order, arrange delivery, prevent fraud, provide customer support or comply with legal obligations.
20. CHANGES TO THESE TERMS
We may update these terms to reflect changes to the business, website, products or applicable law.
The terms in effect when an order is accepted will normally continue to govern that order.
Any updated version will be published on this website with a revised “Last updated” date.
21. SEVERABILITY
If any provision of these terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
An unenforceable provision will be interpreted or adjusted only to the extent necessary to make it lawful and enforceable.
22. GOVERNING LAW AND DISPUTES
These terms and contracts made through this website are governed by Irish law.
If you are a consumer living outside Ireland, this choice of law does not remove any mandatory consumer protections available under the law of your country of residence.
We encourage customers to contact us first so that we can try to resolve any concern directly.
Nothing in these terms prevents a consumer from bringing a claim in any court that has jurisdiction under applicable consumer law.
